Speak Up Policy
Cummins is committed to conducting its business honestly, ethically, and in compliance with all applicable laws and regulations. As part of this commitment, Cummins encourages its Employees and third parties to “Speak Up” and report any actual or suspected violations of law or company policy, or any other ethical concerns that do not align with our culture of compliance. Speaking up in good faith about actual or suspected violations of company policy demonstrates a dedication to our values, including integrity and continuous improvement, as well as a commitment to upholding Cummins’ longstanding reputation of having a strong compliant culture and workplace.
All Speak Up Concerns that are made in good faith will be treated seriously and in a timely manner. Under no circumstances will an individual or third-party be retaliated against for reporting an honest and good faith Speak Up Concern.
The purpose of the Speak Up Policy is to:
- Encourage the disclosure of concerns.
- Help deter or respond to violations of law and company policy in line with Cummins’ risk management and governance framework.
- Provide an understanding of what can and should be reported under the policy.
- Demonstrate the importance Cummins places on ensuring a safe and supportive environment where people feel confident and comfortable raising concerns without fear of retaliation.
- Explain the process for submitting Speak Up Concerns, including what happens when such a report is made.
- Explain how reports of Speak Up Concerns will be protected when made.
Reporting Process
Employees and third parties can submit good faith Speak Up Concerns through the Cummins Ethics Help Line. If a Speak Up Concern is raised anonymously, we will make every effort to keep the reporter identity confidential. Anonymous reporting (if permitted in the country where the individual is located) is possible when using Cummins Ethics Help Line. However, providing as much information as possible makes it easier to investigate properly. The Ethics Help Line is available 24/7 and allows you to submit a report in your chosen language. Investigating Reports
Once a potential violation of law or company policy is reported, the investigation process will begin. During the course of the investigation, you can expect:
- To be treated fairly, with care, and in a professional manner.
- Protection from retaliation.
- Cases to be handled in a timely and confidential manner.
- Regular follow-up throughout the investigation and upon the case being closed.
Cummins has a global investigations program designed to respond to and address concerns in an objective and confidential manner. To preserve the integrity of the investigation, we expect individuals to maintain confidentiality throughout the entire investigation process. The company will keep the investigation as confidential as possible and will share information with individuals only on a need-to-know basis. All reports of Speak Up Concerns will be taken seriously, and Cummins will review every report thoroughly in order to determine the appropriate investigation plan. We ask that reporters provide as much detail as possible, as this has an impact on the success of the investigation process.
